The website is provided for public informational use and for access to public-facing digital services associated with On-Sight Optics, including resource content, contact intake, support routing, public program information, registration pathways, and scheduling access where offered.
Clause 2.2
No Guarantee of Acceptance or Fulfillment
Use of the website doesn't obligate On-Sight Optics to approve a registration or participant, schedule a service, fulfill an order, launch a program, continue a workflow, or provide any product or service unless and until separately confirmed by On-Sight Optics.
Section 03
Eligibility and Permitted Use
Clause 3.1
Age and Legal Capacity
You may use the website only if you have the legal capacity to enter into a binding agreement under applicable law or if you are using the website under appropriate supervision permitted by law.
Clause 3.2
Permitted Purpose
You may use the website only for lawful, authorized, and intended purposes related to learning about On-Sight Optics, requesting support, registering for an employer-sponsored program you are eligible for, or accessing public workflow information.
Clause 3.3
Compliance With Applicable Law
You agree to use the website in compliance with all applicable laws, regulations, and contractual or organizational restrictions that apply to you, including any limitations related to employer authority, confidential information, or regulated health information.
Section 04
Informational Use; No Medical, Legal, or Employment Advice
Clause 4.1
General Informational Content
Website content is provided for general informational purposes only. It isn't medical advice, legal advice, employment advice, insurance advice, or a promise of eligibility, reimbursement, treatment, or regulatory compliance in any specific circumstance.
Clause 4.2
Professional and Employer Review
Prescription decisions, workplace safety decisions, reimbursement questions, and employer-sponsored program determinations should be made through appropriate medical, legal, safety, and employer-specific channels.
Clause 4.3
Optical Retail Services; No Doctor on Site
On-Sight Optics operates as an optical retail provider and works with licensed opticians. On-Sight Optics isn't a doctor's office, doesn't provide on-site eye examinations, and doesn't diagnose eye conditions or determine, adjust, or change a user's prescription.
On-Sight Optics fills eyewear only in accordance with the prescription written by an appropriately licensed prescribing provider and doesn't assume responsibility for prescribing decisions made by a third-party doctor or other licensed prescriber.
Section 05
Employer-Sponsored Program Terms and Eligibility
Clause 5.1
Employer-Controlled Rules
Where the website references employer-sponsored safety-eyewear programs, the employer controls program eligibility, approvals, allowances, frame restrictions, ordering rules, internal authorizations, and policy exceptions.
Clause 5.2
No Override of Employer or Written Program Terms
Public-facing guides and summaries on the website don't override a company program page, a written onboarding document, an employer's internal policy, or any separate written agreement with On-Sight Optics.
Section 06
Submitted Information and Communications
Clause 6.1
Accuracy of Information
If you submit information through the website, including registration details, contact inquiries, support requests, scheduling details, or prescription-related information, you are responsible for ensuring that the information is accurate, complete, current, and submitted by an authorized person.
Clause 6.2
Operational Consequences of Inaccurate Information
Inaccurate or incomplete information may delay support, verification, routing, scheduling, onboarding, or fulfillment and may cause On-Sight Optics to reject, defer, or close a request.
Clause 6.3
Operational Communications
By providing contact information through a website workflow, you consent to receive communications reasonably related to your request, registration, support issue, or scheduling activity, subject to applicable law and the preferences or limitations reflected in the specific workflow.
Clause 6.4
Prescription Submission Requirements
On-Sight Optics may require prescriptions to be current, complete, legible, and signed by an appropriately licensed prescribing provider. On-Sight Optics reserves the right to reject, defer, or request clarification for prescriptions that are expired, missing an expiration date, missing a verifiable provider signature, or otherwise incomplete or invalid on their face.
Section 07
Protected Health Information, HIPAA, and Security
Clause 7.1
HIPAA and Applicable Health-Information Obligations
To the extent On-Sight Optics receives protected health information or electronic protected health information through covered workflows, On-Sight Optics applies administrative, physical, and technical safeguards designed to protect the confidentiality, integrity, and availability of such information in accordance with applicable law, including HIPAA where applicable.
Clause 7.2
Limit Sensitive Information to Designated Channels
The public website isn't intended to function as an unrestricted public repository for medical records. Users should submit only information reasonably requested through designated forms, support tools, or intake channels and should avoid transmitting unnecessary sensitive information through unintended channels.
Clause 7.3
Reliance on Prescribing Providers
On-Sight Optics relies on prescriptions as issued by the user's prescribing provider. On-Sight Optics isn't responsible for prescriptions that are written incorrectly, contain omissions, are no longer clinically appropriate, or result in discomfort, strain, visual dissatisfaction, or other issues attributable to the prescription itself rather than the filling process.
If a user believes a prescription is incorrect, incomplete, or causing strain or other visual issues, the user should consult the prescribing doctor or other licensed prescriber rather than rely on On-Sight Optics to diagnose or revise the prescription.
Clause 7.4
Security Practices
On-Sight Optics maintains reasonable safeguards intended to protect website operations and data submitted through authorized workflows. However, no internet-based transmission, storage environment, or technical platform can be guaranteed to be fully secure, uninterrupted, or error-free.

Clause 8.2
Separate Terms and Availability
Those third-party services may operate under separate terms, privacy practices, accessibility conditions, uptime commitments, and data-handling environments. On-Sight Optics isn't responsible for the independent acts, omissions, policies, or availability of third-party services except to the extent required by law.
Clause 8.3
No Endorsement or Warranty of Third Parties
Links to or integrations with third-party services don't constitute an endorsement, guarantee, or warranty by On-Sight Optics of those providers or their products, services, security, accessibility, or legal compliance.

As-Is and As-Available Disclaimer
To the fullest extent permitted by law, the website and its public content are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

On-Sight Optics doesn't warrant that website content is always complete, current, accurate, uninterrupted, secure, or error-free, or that every workflow will remain available at all times.
Clause 11.3
Prescription and Visual-Outcome Disclaimer
On-Sight Optics doesn't warrant the accuracy, suitability, or medical appropriateness of a prescription issued by a third-party prescriber. Subject to applicable law, On-Sight Optics isn't responsible for visual strain, discomfort, or dissatisfaction caused by an incorrect, incomplete, invalid, or outdated prescription supplied by or on behalf of the user.

Where liability can't be fully disclaimed, it will be limited to the maximum extent permitted by applicable law.
Clause 12.3

To the extent a limitation of liability is permitted under applicable law, and to the extent liability is imposed notwithstanding these Terms, the aggregate liability of On-Sight Optics arising out of or relating to the website won't exceed one hundred U.S. dollars (US $100.00) or the amount you paid, if any, to use the specific website service giving rise to the claim, whichever is greater.
Clause 12.4
Applicable Exceptions
Nothing in these Terms is intended to limit liability to the extent such limitation is prohibited by applicable law.
Section 13
Indemnification
Clause 13.1
Your Indemnification Obligation
You agree to defend, indemnify, and hold harmless On-Sight Optics and its affiliates, officers, employees, contractors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your violation of these Terms, your misuse of the website, or your submission of unlawful, unauthorized, inaccurate, or infringing information.

Equitable Relief and Protective Remedies

Section 17
Miscellaneous Provisions
Clause 17.1
Severability and Waiver
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law. A failure by On-Sight Optics to enforce any provision doesn't waive that provision or any other right.

These Terms govern public website use unless a different written agreement, workflow-specific notice, or supplemental term expressly applies to a particular activity.
